Here are the terms and conditions (the terms) for selling your phone on the site.
The site and services are operated by Mobile Phone Xchange Ltd on our behalf.
When using this site and selling your phone, you will be contracting with us (our company information is at the end of these terms).
We recommend you read these terms carefully before using the site and submitting your
sell order. They are designed to ensure that you get paid correctly, and without undue delay.
On the check-out page you will need to tick the box indicating that you accept them. If you don’t want
to accept, you will not be able to place a sell order on the site.
The FAQs may help to answer your queries on how the service operates.
In these terms, "consumer" means an individual who is not a business,
not holding themselves out as a business nor selling phones in the course of a business.
By placing an order you agree that:
If you are a consumer, these terms will not affect any rights you may have under
any law and which we can’t exclude.
By placing an order through the site, you warrant that:
All mobile phone dealers, stockists and specialist retailers and distributors of mobile
phones are excluded from the offers on this site unless a specific exception has
been agreed in writing with us.
Phones must arrive within fourteen days of the date of the quotation.
If they arrive later we’ll offer the lower of (i) the quote price or (ii) the then-current price on the site
on the day the phone(s) reach the warehouse, subject to the "Full Working Order" section below.
It's your responsibility to remove the SIM card from the phone and remove any content or data from the phone
before sending it to us. SIM cards and your phone can contain private information, and may enable
unauthorised use of mobile network services.
If you fail to remove your SIM card or remove any data or content from your phone, you agree we’re not responsible for any claims,
losses or damages relating to the use of the SIM card or any data or content arising before, or after we receive the phone(s) you’ve sent us.
Please don’t forget, we won’t return any SIM cards we receive.
We’re not responsible for protecting any information on the phone and it’s
not possible for you to obtain any content from the phone, whether stored on the phone or memory card, once it has been
sent to us. We strongly recommend you back up such contents before sending any phone(s) to us.
What is meant by Full Working Order?
We do accept accessories such as chargers and headsets but these do not increase the
value of your sale order.
Mobile Phone Xchange Limited working to our guidelines will decide if a phone is in full working order. If your phone is assessed as not being in full
working order, the options open to you are set out in the “Phone Returns and Adjusted Payments” section below.
To qualify for the Brand New Phone valuation your phone must meet the following
Failure to meet these requirements may decrease the Brand New Phone valuation.
Should you return either a prototype, or a different model than that quoted on your
order we will offer an amount for the returned model based on the price displayed
on the site on the day the model or prototype is returned. Generally we don't pay
any amount for prototypes or samples.
"Lost, Blocked or Stolen phones" are phones that have been reported as either lost,
blocked or stolen in any of the stolen asset registers maintained by CheckMEND which
is operated by Recipero Limited at http://www.checkmend.com.
Phones which are “Lost, Blocked or Stolen” will be dealt with in accordance with
Home Office guidelines; phones will be held pending a claim from either the Police,
an insurance company or the registered owner and no amounts will be paid to the
person who sent the phone to us.
"Fake Phones" are counterfeit phones which are manufactured to resemble products
made by another company in beach of copyright and intellectual property rights.
We will make no payments to customers for Fake Phones.
We will inform the relevant authorities if there is any suspicion
that there is a deliberate attempt to commit fraud. We may
reclaim any money paid to you or a business if it is discovered within three(3)
months of the return of a phone that the phone has either been reported "lost, blocked or stolen" by
the (seller of the phone,) or the phone is discovered to be a Fake Phone.
We may refuse to pay for any phones which we believes are derived
from "Box breaking". Our definition of "Box breaking" is where
a business or individual purchases phones with the intention of reselling the phone
and no intention of using the phone and SIM card together as was the original intention
of the mobile phone network whose SIM card was provided with the phone.
Once your phone(s) has been received and inspected, we will contact you either by email
or text (depending on what you have indicated in your order) to confirm the amount
we will offer for them (as adjusted, if necessary, by our decision in accordance
these terms). If we have offered you a revised amount and you do
not reply within three (3) working days we will pay you the revised amount. We are
not responsible if emails are not received because of reasons outside
our reasonable control, for example spam email or junk filters. We recommend you add
email@example.com to your “safe senders” list.
If you choose to decline the offer within the 3 day period, you may ask us to return
the phone(s) to you. Please be aware, phones will not be returned after this
three(3) day period.
Additional accessories that have been sent in with your phone(s) which have not
been requested by us cannot be returned.
During the checkout process you'll be asked to select a payment method for your
phone(s). This payment method cannot be changed once the order has been placed or
accepted by us.
We provide payments to you as follows:
Cheques - 3 working days after we have received and inspected your phone(s);
Same day money transfers or voucher payments - within 24 hours of receipt and inspection of your phone(s).
Please note that payments will only be made using the details given during the checkout
. If you have lost your cheque or voucher you can request for it to be cancelled
and re-issued. A cancellation fee of £7 will apply and will be deducted from the
re-issued cheque or voucher amount.
All valuations and payments include VAT unless otherwise stated.
We are not responsible for any loss or damage incurred to your phone(s) from
the time they leave you until they are received at the warehouse.
For each package you send us it is your responsibility to:
